Dear Francesca Owners,
We write with an update on the litigation that a fellow owner, Robert Cohn, initiated against the Francesca related to a pipe leak back in 2022 that caused damage to the unit below his. This matter was settled in principle yesterday with the assistance of a trial court judge without assignment of liability or responsibility for the leak at issue.
As we’ve communicated in the past, our board, and previous ones, put forward multiple good-faith settlement proposals before and after the initiation of litigation against the Association in the hope of sparing both parties costly litigation. Despite the strength of the Association’s case, our insurer, which was paying the majority of our legal fees to try this case, was also urging us to settle the matter, which we were finally able to do. The cost of the settlement is being entirely borne by insurance other than a small deductible. A full, formal agreement is being negotiated by counsel and we will provide that to all members once it is finalized.
The settlement of this case brings finality, stops legal costs, and removes the cloud of litigation. We presumed that whatever outcome occurred at trial would be subject to appeals and therefore drag this dispute out for a lengthy period, which is simply not in the homeowners’ interest.
Now that this matter is behind us, we can focus more of our time, energy and Association funds on the things that will benefit our community.
